SECTION I

1. APPLICABLE LEGISLATION

The following rules expand, transcribe and complete the Royal Order number 27 of the 25th March 1988 and the Ministerial Order of the 14th March 1988 (BOE 22.04.88). In the matters not regulated by the following General Conditions the above mentioned orders are to be applied.

2. RESERVATIONS

When reserving the property, the client is to pay 50% of the total rental price. The reservation is not valid unless this payment of the deposit is made. The remaining balance is to be paid at least 30 days prior to the date of arrival. In case this is not done, the reservation will be cancelled. In case the reservation is made 30 days or less prior to the date of arrival the client is to pay the full amount of the renting price. Once the deposit payment of 50% is made and reconfirmed by Finca Can Toni, the reservation is considered valid. In case of cancellation, the rules of Section III, paragraph 2. are to be applied.

SECTION II

1. PRESENTATION

As a general rule the rooms can be occupied from 4 p.m. onwards on the day of arrival. The checkout is to be before 10 a.m. on the day of departure.

Before arrival, it is essential for the client to inform about the times of arrival and departure as well as the means of transport (aeroplane or boat) in order to accompany him/her to Finca Can Toni. The hours of this service are from 4 p.m. to 12 p.m. from Monday to Sunday.

2. DOCUMENTATION

Once the reservation has been made the client will receive a booking confirmation voucher. As soon as the full rental has been paid the client will receive a voucher indicating the full payment. The client will be met at his/her arrival in Ibiza (airport or port). Normally the client will be accompanied to the property, but in case this does not occur, he/she will be given an illustrated map in order to find the property without any problem.

SECTION III

1. ALTERATIONS

Finca Can Toni reserves the right to canzle the reserved property by due to force majeure for which Finca Can Toni can not be made responsible.

2. CANCELLATIONS

Cancellation Policy of Finca Can Toni

Cancellation of the reservation up to 30 days prior to arrival:

100% of the total price

Cancellation of the reservation up to 1 day prior to arrival or “no show” or in the case of anticipated departure:

100% of the total price

The above mentioned percentages are based on the total amount of the stipulated rental price.

3. ABNORMALITY OR DEFICIENCY

The irregularities and/or shortcomings the client may find in the rented property are to be communicated to Finca Can Toni as soon as possible and during the client’s stay in Ibiza.

Finca Can Toni will promptly solve any abnormality or deficiency and even change the property in case the deficiencies in the first property are proved to be insurmountable. Complaints that take place after the client has left the property will not be attended as they lack the fundamental basis of the reclamation.

SECTION IV

1. ACCEPTANCE OF THESE CONDITIONS

The claim to the product offered and published means the explicit acceptance by the client of all and every one of the General Conditions.

Any reclamations that may be made by the client or Finca Can Toni fall under the jurisdiction of the Court of Law of Ibiza, waiving any other jurisdiction.

1. LEGISLACIÓN APLICABLE

Las siguientes normas obligarán a las partes en cuanto, sin imponerse al Real Decreto n. 27 del 25.03.88 y Orden Ministerial del 14.03.88 (BOE 22.04.88), lo desarrollan, transcriben o completan. Las materias no reguladas en estas Condiciones Generales se regirán por el citado ordenamiento reglamentario.

 

2. RESERVAS

En el momento de realizar la reserva, el cliente deberá depositar el 50% del importe del alquiler solicitado, no considerándose la reserva en firme hasta haber efectuado dicho depósito. El saldo restante deberá abonarse al menos con 30 días de antelación a la fecha de entrada a la propiedad. En caso contrario, se dará por cancelada la reserva. Si la reserva se efectúa con 30 días o menos previos a la fecha de entrada a la propiedad, el cliente deberá abonar el importe total del alquiler contratado. Una vez depositado el 50%, y ya confirmada la propiedad por Finca Can Toni, se considerará la reserva en firme y se aplicarán los gastos de anulación en la Sección III, párrafo 2.

 

SECCIÓN II

1. PRESENTACIÓN

Como norma general, las habitaciones se ocuparán a partir de las 16 horas del día de llegada y deberán quedar libres antes de las 10 horas del día de salida.

Es imprescindible comunicar las horas de llegada y salida, así como el medio utilizado (avión o barco), antes de su llegada a la isla para poder así acompañarles a la Finca Can Toni. Las horas de atención y acompañamiento son desde las 16 horas hasta las 24 horas, de lunes a domingo.

2. DOCUMENTACIÓN

Una vez realizada la reserva, el cliente recibirá la confirmación de la reserva y, al pago del importe total del alquiler solicitado, recibirá un bono que acredita el pago total. Se les atenderá a su llegada al puerto o aeropuerto de Ibiza y se les acompañará a la Finca Can Toni. En su defecto, se adjuntará un mapa / croquis de la situación de la propiedad para acceder a ella con facilidad.

SECCIÓN III

1. ALTERACIONES

Finca Can Toni se reserva el derecho de canzelar la reservada por causas por fuerza mayor, ajenas a Finca Can Toni.

2. ANULACIONES

Condiciones de Cancelación Finca Can Toni

Cancelación de la reserva hasta 30 días antes:

100% del importe total

o “no show”, o en el caso de salida anticipada:

100% del importe total

Los porcentajes se entienden sobre el importe total contratado.

3. ANOMALÍAS O DEFICIENCIAS

Las irregularidades y/o deficiencias que el cliente pueda encontrar en la propiedad alquilada deberán ser comunicadas a Finca Can Toni en Ibiza, lo antes posible y siempre durante la estancia.

Finca Can Toni solucionará en breve plazo cualquier anomalía o deficiencia si así se estimará, siempre que las causas aducidas sean comprobadas como ciertas.

Toda reclamación efectuada después de abandonar la propiedad no podrá ser atendida por carecer de los más elementales criterios que pudieran tramitar la reclamación.

SECCIÓN IV

1. ACEPTACIÓN DE ESTAS CONDICIONES

El hecho de tomar parte en el producto ofrecido y publicado en el presente catálogo supone la expresa aceptación por parte del cliente de todas y cada una de las Condiciones Generales.

Para el conocimiento de todas las reclamaciones que puedan formularse, tanto el cliente como Finca Can Toni, se someten expresamente a la jurisdicción de los Tribunales de Ibiza, con renuncia a cualquier otro fuero.

1. ANWENDBARE GESETZGEBUNG

Die folgenden Normen verpflichten die Parteien und entwickeln, übernehmen und
vervollständigen die Königliche Verordnung mit Gesetzeskraft Nr. 27 vom 25.03.88
und die Ministerielle Verordnung vom 14.03.88 /(BOE 22.04.88), ohne vor jenen
Vorrang zu haben. Die nicht in diesem allgemeinen Geschäftsbedingungen erfaßte
Materie wird von den oben genannten Verordnungen geregelt.

2. BUCHUNGEN

Bei Vornahme der Buchung muß der Kunde 50% des verlangten Mietpreises
hinterlegen. Die Reservierung gilt erst nach erfolgter Anzahlung als rechtsgültig.
Der restliche Betrag muß bei Anreise gezahlt werden. Im gegenteiligen Fall wird die
Buchung storniert. Sollte die Buchung 30 Tage oder weniger vor dem Anreisetag
erfolgen, so muß der Kunde den gesamten vereinbarten Mietpreis zahlen. Nach
erfolgter Anzahlung von 50% des Preises und Rückbestätigung durch Finca Can Toni
gilt die Buchung als rechtskräftig und es finden die Stornierungskosten gemäß dem
Abschnitt III, Absatz 2 Anwendung.

ABSCHNITT II

1. Anreise

Check in ab 16.00 Uhr Check out bis 10.00 Uhr am Tage der Abreise.

2. UNTERLAGEN

Sobald die Buchung erfolgt ist, erhält der Kunde die Buchungsbestätigung, eine
Karte / Lagezeichnung des Objektes, damit Ihre Anfahrt problemlos verläuft.

ABSCHNITT III

1. ÄNDERUNGEN

Finca Can Toni behält sich das Recht vor, auf Grund von höherer Gewalt, die
nicht von Finca Can Toni zu verantworten ist, die Buchung zu stornieren.

2. STORNIERUNGEN

Stornierungsbedingungen Finca Can Toni

Stornierung der Buchung bis 30 Tage vorher:

50% des Gesamtpreises

Stornierung der Buchung  „no show“, oder bei
vorzeitiger Abreise

100% des Gesamtpreises

Die Prozentsätze verstehen sich über den vertraglich abgeschlossenen
Gesamtpreis.

3. REGELWIDRIGKEITEN ODER MÄNGEL

Sollte der Kunde Mängel feststellen, so müssen diese baldmöglichst und auf alle
Fälle während des Aufenthaltes an Finca Can Toni in Ibiza mitgeteilt werden.

Finca Can Toni behebt in kürzester Zeit jedwede Mängel, wenn dies für notwendig
erachtet wird, unter der Voraussetzung, daß die vorgebrachten Gründe als
tatsächlich vorhanden nachgewiesen werden können.

Jegliche Reklamation nach Verlassen des Objektes kann nicht mehr berücksichtigt
werden, da sie nicht über die grundlegenden Kriterien für deren Bearbeitung
verfügt.

ABSCHNITT IV

1. ANNAHME DIESER BEDINGUNGEN

Die Inanspruchnahme der in diesem Katalog angebotenen und veröffentlichten
Produkte bedeutet die ausdrückliche Annahme aller und jeder einzelnen der
allgemeinen Geschäftsbedingungen.

Zur Entscheidung jedweder Geltendmachung, die vorgebracht werden könne,
unterwerfen sich sowohl der Kunde wie auch Finca Can Toni ausdrücklich der
Rechtsprechung der Gerichte von Ibiza, unter Verzicht auf jeden anderen
Gerichtsstand.
